Conveyancing: Definition
The legal work involved in transferring the ownership of land.

Buying and selling: Initial Work

  • Sale: Draft contract, requisition title deeds, and address buyer’s enquiries.

     

  • Purchase: Undertake searches, make enquiries with the seller re the property, and arrange mortgage if necessary.

Searches
Local authority search: Will reveal details such as planning permissions granted and any plans to build roads in close proximity to the property. Others searches include:-

  • Drainage Search: Usually insisted upon by mortgage provider. Search details whether waste water from the property flows out into a public or private sewer.

     

  • Other Searches: Land registry search to determine whether vendor is the legal owner with the right to sell the property. A bankruptcy search is undertaken at the mortgage providers behest to ascertain whether the buyer is bankrupt.

     

  • Searches: Regional variations

     

    • Cheshire: Brine search.

    • Cornwall: Tin mining search.

    • Midlands: Coal mining search.

Surveys
Purchasers mortgage provider will require a valuation. Nevertheless, it is advisable to also have a survey carried out on top of the valuation as likely to reveal any work which is required on the property. Should it do so, then the purchaser can renegotiate the purchase price to take account of it.

Exchanging and completion
A date for exchange of contracts can be arranged once the survey, searches, and enquiries are complete and a mortgage offer obtained. Once exchanged, the buyer is then committed to the purchase and could only then pull out by compensating the vendor.

A date for completion is incorporated into the contracts and the completion date is the date upon which the purchaser formally becomes the new owner of the property.
